National emergency declared at the southern border

On 20 January 2025 President Donald J. Trump signed Proclamation 10886, “Declaring a National Emergency at the Southern Border of the United States,” invoking §§ 201 and 301 of the National Emergencies Act (50 U.S.C. §§ 1621, 1631).¹²³ The proclamation directs the Secretary of Defense to order units and members of the Ready Reserve to active duty under 10 U.S.C. § 12302(a) and to “take all appropriate actions … to construct additional physical barriers along the southern border,” in coordination with willing state governors, citing 10 U.S.C. §§ 2214 and 2808 as construction authorities.¹⁴⁵⁶ Companion same-day instruments include Executive Order 14157 (“Designating Cartels and Other Organizations as Foreign Terrorist Organizations and Specially Designated Global Terrorists”), Executive Order 14159 (“Protecting the American People Against Invasion”), Executive Order 14163 (“Realigning the United States Refugee Admissions Program” — suspending USRAP under INA § 207), Executive Order 14165 (“Securing Our Borders”), Executive Order 14167 (“Clarifying the Military’s Role in Protecting the Territorial Integrity of the United States”), and Proclamation 10888 (“Guaranteeing the States Protection Against Invasion”).^789101112

1. The Ready Reserve call-up under 10 U.S.C. § 12302(a) is statutorily capped at 24 consecutive months for any member ordered to active duty.⁴ Department of Defense funds reprogrammable under 10 U.S.C. § 2808(a) become available to undertake “military construction projects … that are necessary to support such use of the armed forces,” limited under § 2808(b) to unobligated balances of military-construction appropriations and subject to the congressional-notification requirement of § 2808(e).⁶

2. National Guard status modes carry distinct Posse Comitatus consequences: State Active Duty (under a governor’s command, not federalised) sits outside 18 U.S.C. § 1385; Title 32 § 502(f) funded duty (federally funded, state-commanded) sits outside § 1385; Title 10 § 12406 federal service triggers § 1385; the DC National Guard under 32 U.S.C. § 105 sits in peacetime presidential command in militia capacity, outside § 1385 when acting in that militia capacity.¹³ Members of the National Guard ordered to federal active duty under Title 10 pursuant to this proclamation therefore become subject to § 1385, which generally bars federal active-duty forces from direct civilian law-enforcement roles absent a statutory exception such as the Insurrection Act.¹⁴

3. Section 6 of the proclamation requires a 30-day Department of Defense report on actions taken and a 90-day joint report by the Secretaries of Defense and Homeland Security, “including whether to invoke the Insurrection Act of 1807.”¹ The Insurrection Act, codified as amended at 10 U.S.C. §§ 251–255 — with §§ 252 (federal use of armed forces against obstruction of federal law) and 253 (interference with constitutional rights) as the operative grants — would, if invoked, authorise federal military participation in civil law enforcement.¹⁵
