EO 14316 extends reciprocal-tariff pause to 1 August 2025

On 7 July 2025 President Donald J. Trump signed Executive Order 14316, “Extending the Modification of the Reciprocal Tariff Rates,” amending Executive Order 14266 of 9 April 2025 (which had paused the country-specific reciprocal rates established by Executive Order 14257 of 2 April 2025) to push the operative effective date from 12:01 a.m. EDT on 9 July 2025 to 12:01 a.m. EDT on 1 August 2025.123 The 10 per cent reciprocal baseline tariff that has been in force since 12:01 a.m. EDT on 5 April 2025 remains unchanged; the country-specific rates take effect on 1 August 2025 unless further modified by subsequent executive order. EO 14316 leaves the People’s Republic of China outside the pause: cumulative duties on Chinese-origin goods remained at the elevated post-EO 14266 level (commonly reported at 145 per cent for covered articles combining the 20 per cent IEEPA fentanyl duty and the 125 per cent reciprocal component).4 The order invokes IEEPA (50 U.S.C. § 1702(a)(1)(B)), the National Emergencies Act (50 U.S.C. § 1601 et seq.), § 604 of the Trade Act of 1974 (19 U.S.C. § 2483) and 3 U.S.C. § 301.567 The administration paired the extension with letters President Trump posted to Truth Social addressed to roughly fourteen foreign leaders announcing country-specific rates effective 1 August, which became the predicate for Executive Order 14326 of 31 July 2025.89 V.O.S. Selections, Inc. v. United States, No. 25-1812 (Fed. Cir.), challenging the underlying IEEPA tariff authority, was at the Federal Circuit on expedited en banc review with oral argument scheduled for 31 July 2025.10

EO 14316 is an amending order: the IEEPA authority and the NEA national-emergency declaration in EO 14257 remain in force under NEA § 202, 50 U.S.C. § 1622, and the country-specific rates can be reinstated or further modified by additional executive order without a fresh emergency declaration.11

  2. The 23-day extension (from 9 July to 1 August 2025) creates additional time for the country letters President Trump sent to foreign leaders to convert into country-specific rate commitments, which then become operative under EO 14326 of 31 July 2025.89

  3. Importers face an extended period of rate uncertainty. Inventory and sourcing decisions calibrated to the 9 July reset reprice to the 1 August horizon; entries during the extension continue to clear at the 10 per cent reciprocal baseline at HTSUS Chapter 99 subchapter III subheading 9903.01.25, with the country-specific rates pre-staged at the suspended 9903.01.43-9903.01.76 family.1213
