DOGE established by executive order

On 20 January 2025 President Donald J. Trump signed Executive Order 14158, “Establishing and Implementing the President’s ‘Department of Government Efficiency’,” which “publicly renamed” the United States Digital Service as the “United States DOGE Service (USDS)” and established it within the Executive Office of the President.1 Section 3(a) places the Administrator of USDS under the White House Chief of Staff; § 3(b) establishes a separate “U.S. DOGE Service Temporary Organization” and provides that it “shall terminate on July 4, 2026,” within the three-year appointment ceiling that 5 U.S.C. § 3161(b)(2) sets for personnel of temporary organisations (with the definitions of “temporary organization” at § 3161(a)).12 Section 3(c) directs each agency head, within 30 days of the order and in consultation with the USDS Administrator, to “establish within their respective Agencies a DOGE Team of at least four employees,” typically including one team lead, one engineer, one human-resources specialist and one attorney.1 The order was one of a same-day Day-1 package; companion workforce instruments include the Hiring Freeze presidential memorandum, Executive Order 14170 (“Reforming the Federal Hiring Process and Restoring Merit to Government Service”), and Executive Order 14171 (“Restoring Accountability to Policy-Influencing Positions Within the Federal Workforce” — the Schedule Policy/Career order).345

  1. USDS gains a coordinating role across executive agencies. Agency DOGE teams report into USDS in addition to their existing reporting lines, and agency heads are directed to facilitate USDS access to unclassified records and IT systems under § 4 of the order.1

  2. The temporary organisation’s hiring authority runs through 5 U.S.C. § 3161(b), which permits appointments of up to three years that may be extended for up to an additional two years “under regulations prescribed by the Office of Personnel Management.”6 Personnel transferring into the temporary organisation are not subject to ordinary competitive-service classification or examination timelines.

  3. The 4 July 2026 sunset fixed by § 3(b) of the order is the outer bound for operational changes made under DOGE authority.1 Permanent retention of any such change requires either statutory action by Congress or transfer of functions to a permanent agency before the sunset.
